1. Acceptance of These Conditions

By accessing this website, registering an account, or placing an order, you confirm that you have read, understood, and agreed to be bound by these Conditions of Use, together with any policies referred to here, including our Privacy Policy and our Shipping & Returns Policy.

If you do not accept any part of these conditions, please discontinue use of the website.

2. Definitions

• "Products" means Benjarong ware, ceramics, souvenirs, packaging, and any other goods or services offered by the Company through this website.
• "Custom Order" means any Product manufactured or decorated to a customer's specific requirements, including logo printing, bespoke patterns, specified colours, or custom packaging.
• "Customer" or "you" means any individual or legal entity accessing this website or placing an order.

3. Eligibility and Member Accounts

3.1 You must be at least 20 years of age, or otherwise legally capable of entering into a binding contract. Customers below this age require the consent of a parent or legal guardian.

3.2 You agree to provide accurate, complete, and current information, particularly the recipient's name, delivery address, and tax invoice details. The Company is not liable for loss arising from incorrect information supplied by you.

3.3 You are responsible for keeping your password confidential and for all activity carried out under your account.

3.4 The Company reserves the right to suspend or close any account where there are reasonable grounds to suspect fraudulent use or breach of these conditions.

4. The Nature of Handmade Ceramics and Acceptable Variation

Benjarong is a handcrafted art form. Every piece is hand-painted and kiln-fired individually. By ordering, you acknowledge and accept the following characteristics, which are inherent to the craft and are not defects:

4.1 Colour. The actual piece may differ from the images shown on screen, due to individual display settings and the natural behaviour of glazes and enamels during firing.

4.2 Pattern. Hand-painted decoration may vary slightly between pieces in detail, placement, and line weight. This variation is a hallmark of genuine handwork.

4.3 Dimensions and weight. All measurements are approximate and may vary by approximately ± [5]% as a result of clay shrinkage during firing.

4.4 Natural firing characteristics — minor specks within the glaze, stilt or contact marks on the foot, or slight unevenness in the brilliance of applied gold — are normal outcomes of the production process.

4.5 For large orders where colour consistency is important, we recommend producing the full quantity in a single firing batch, as glaze colour may vary slightly between batches.

5. Pricing, Product Information, and Errors

5.1 All prices are shown in Thai Baht (THB), [inclusive of / exclusive of] VAT, and exclude delivery charges, special packaging, and logo-printing service fees unless stated otherwise.

5.2 The Company may change prices, product details, and promotions at any time without prior notice. Such changes do not affect orders already confirmed by the Company.

5.3 Where an obvious error appears in a price or product description, the Company may cancel the affected order and refund you in full. We will notify you promptly if this occurs.

5.4 Products may be limited in quantity or out of stock. An order is only complete once the Company has confirmed availability.

6. Orders and Order Confirmation

6.1 An order submitted by you constitutes an offer to purchase. A contract of sale is formed only when the Company issues an order confirmation, a signed quotation, or an email confirming receipt of payment.

6.2 The Company reserves the right to decline or cancel any order where stock is unavailable, information is incomplete, fraud is suspected, or other reasonable grounds exist. Any payment already received will be refunded in full.

6.3 Quotations are valid for [30] days from the date of issue unless stated otherwise.

7. Custom Orders and Logo Printing (Corporate Gifts / OEM)

7.1 Minimum order quantity. Custom Orders are subject to the minimum order quantity (MOQ) stated on the relevant product page or in the quotation.

7.2 Deposit. Custom Orders require a deposit of [50]% before production begins, with the balance payable before dispatch.

7.3 Artwork approval. You must review and approve the artwork proof or physical sample in writing before full production starts. Once approved, we produce strictly to the approved artwork. The Company accepts no liability for spelling, logo versions, colours, or other details contained in artwork you have approved.

7.4 Amendments and cancellation. Once production has commenced, orders cannot be cancelled or amended. In the event of cancellation, the deposit is non-refundable and the Company may invoice for costs actually incurred up to that point.

7.5 Delivered quantity. For volume production, the quantity delivered may vary from the quantity ordered by up to ± [5]%, in line with normal practice for kiln-fired goods. Invoicing is based on the quantity actually delivered.

7.6 Production lead time. Approximately [15–45] working days from artwork approval and receipt of deposit. Lead times may vary with workload and season, and are given as a good-faith estimate rather than a fixed contractual deadline unless agreed in writing.

7.7 Customer's marks. You warrant that you own, or are lawfully entitled to use, any logo, trademark, image, or text supplied to us for production, and you agree to indemnify the Company against any third-party claim of infringement.

7.8 The Company may photograph completed work and publish it as a portfolio reference. If you do not wish your commission to be published, please notify us in writing before delivery.

8. Payment and Tax Documents

8.1 Accepted payment methods are those shown at checkout, including bank transfer and any other channel announced by the Company.

8.2 Title in the Products passes to you only upon receipt of payment in full.

8.3 If a tax invoice is required, please supply the full registered name, address, and tax identification number before documents are issued. The Company is not obliged to reissue or amend tax documents retrospectively beyond [stated period].

8.4 Corporate customers required to deduct withholding tax must provide the withholding tax certificate as required by Thai law.

9. Delivery and Risk

9.1 We deliver within Thailand and internationally as agreed, at the rates shown during checkout.

9.2 Delivery times are estimates. The Company is not liable for delays caused by carriers, weather, customs clearance, or other events outside our control.

9.3 International shipments. You are responsible for all import duties, taxes, and charges in the destination country, and for confirming that the Products may lawfully be imported there.

10. Exchanges, Returns, and Refunds

10.1 We will exchange or refund Products that are defective in manufacture, damaged in transit, or incorrectly supplied, provided you notify us within the period set out in clause 9.4.

10.2 Returned Products must be unused and in their original condition, complete with packaging and documentation.

10.3 Exclusions. We are unable to accept exchanges or returns in the following cases:

• Custom Orders, logo-printed items, and anything produced to your specification;
• Variation in colour or pattern that falls within the normal characteristics described in clause 4;
• Damage caused by use, storage, or handling after delivery;
• Clearance items or Products marked as non-returnable.

10.4 Approved refunds are issued to the original payment method within [14] working days of approval.

11. Use and Care of the Products

11.1 Products decorated with gold are not microwave safe and are not recommended for dishwashers, as this will degrade the gold.

11.2 Display pieces, decorative objects, and any item described as "for display" are not intended to hold food or beverages.

11.3 The Company is not liable for damage resulting from use contrary to the guidance above.

12. Intellectual Property

12.1 All content on this website — product photography, illustrations, text, pattern names, product designs, logos, and the site design itself — is the intellectual property of the Company or its licensors and is protected by law.

12.2 You may not reproduce, adapt, distribute, sell, or commercially exploit any of this content without our prior written consent. This includes copying product images for use on other sales channels.

12.3 Reproducing our product designs or decorative patterns constitutes infringement, and the Company reserves the right to pursue all available legal remedies.

12.4 Limited use for reference, study, or review is permitted provided the source is credited as www.benjarong.net.

13. Customer-Submitted Content

13.1 By posting a review, comment, or image on this website, you grant the Company a royalty-free right to publish, reproduce, and adapt that content for promotional purposes.

13.2 You must not submit content that is unlawful, defamatory, obscene, misleading, or infringes the rights of others. We may remove such content without prior notice.

14. Prohibited Use

You agree not to:

• use this website for any unlawful or fraudulent purpose;
• attempt to breach, probe, or disrupt the security or operation of our systems, or distribute malicious code;
• use automated tools to scrape or harvest data for commercial purposes;
• place orders using false information or another person's details without authorisation.

15. Third-Party Links

This website may link to third-party services such as LINE, Facebook, Google Maps, or payment providers. We do not control and are not responsible for the content or policies of those services.

16. Limitation of Liability

16.1 The website is provided on an "as is" basis. We do not warrant that it will be uninterrupted or free from error.

16.2 To the fullest extent permitted by law, our liability in respect of any order shall not exceed the value of the Products in that order, and we shall not be liable for indirect loss, loss of business opportunity, or loss of anticipated profit.

16.3 Nothing in this clause limits your statutory rights under Thai consumer protection law.

17. Force Majeure

The Company is not liable for delay or failure to perform arising from events reasonably beyond our control, including natural disaster, flood, epidemic, government order, power failure, shortage of raw materials, or kiln failure.

18. Personal Data

The collection, use, and disclosure of your personal data is governed by our Privacy Policy, prepared in accordance with the Personal Data Protection Act B.E. 2562 (2019), which forms part of these conditions.

19. Changes to These Conditions

We may amend these conditions at any time. The revised version will be published on this page with an updated date. Continued use of the website after publication constitutes acceptance of the revised conditions.

20. Governing Law and Disputes

These conditions are governed by the laws of Thailand. In the event of a dispute, the parties agree to negotiate in good faith in the first instance. Failing resolution, the courts of Thailand shall have jurisdiction.
